Welcome to Memorial Crystals™. These Terms & Conditions govern your use of our website, products, services, photo upload tools, ordering process, and related communications. By visiting our website, placing an order, uploading a photo, or using our services, you agree to these Terms & Conditions.

Please read them carefully. If you do not agree with these Terms, you should not use this website or place an order.

1. Our Products and Services

Memorial Crystals™ creates personalized crystal keepsakes using customer-provided photos, artwork, names, dates, messages, and other submitted details. Our products may include 2D or 3D crystal engravings, light bases, ornaments, keychains, jewelry items, memorial keepsakes, pet keepsakes, and related personalized gifts.

Because each item is custom-made, the final product is created specifically for the customer and cannot be resold as a standard inventory item. By placing an order, you acknowledge that your product will be personalized using the image, text, options, and placement information you provide, along with any professional adjustments made by our 3D artists or production team.

2. Photo Uploads and Customer-Provided Content

When you upload a photo, image, logo, text, name, message, or other content, you confirm that you have the legal right to use and submit that content for the purpose of creating your personalized product. You also grant Memorial Crystals™ and its trusted production partners permission to use the uploaded content solely as necessary to review, prepare, edit, convert, engrave, manufacture, fulfill, and support your order.

Uploaded images may be reviewed by a live 3D artist or production specialist. Backgrounds may be removed, subjects may be adjusted, and images may be prepared for engraving to improve clarity, composition, depth, and final presentation. While we make reasonable efforts to preserve the spirit and likeness of the submitted photo, final engraving results may vary based on the quality, lighting, angle, resolution, and suitability of the original image.

All uploaded images associated with a fulfilled order are purged 30 days after the order is completed, unless retention is required for customer support, dispute resolution, fraud prevention, legal compliance, or another legitimate business purpose.

3. Image Quality and Artwork Suitability

The quality of the final crystal depends heavily on the quality of the uploaded photo. Clear, well-lit images with visible facial details, good contrast, and minimal obstruction generally produce the best results. Low-resolution images, dark images, blurry images, heavily filtered images, screenshots, cropped faces, or photos with important details missing may result in reduced engraving quality.

If our team identifies a concern with the submitted image, we may contact you using the email address or phone number provided with your order. If we are unable to reach you, we may either proceed using the image provided, make reasonable artistic and technical adjustments, delay production until we receive a response, or cancel and refund the order at our discretion.

4. Customer Approval and Placement

Some products may include an online placement tool, preview, or upload frame that allows you to position your photo before checkout. This placement is used as guidance for the final design and production process. After purchase, your placement may be reviewed and refined by a 3D artist or production specialist for final alignment, cropping, engraving suitability, and visual balance inside the selected crystal.

Digital previews, placement images, mockups, or website product images are for general visualization only. They may not perfectly represent the final engraved result, crystal clarity, light refraction, scale, depth, or appearance under different lighting conditions.

5. Personalization Details

You are responsible for reviewing all personalization details before placing your order, including names, dates, spelling, punctuation, photo selection, crystal shape, product size, orientation, base selection, shipping address, and any special instructions. Memorial Crystals™ is not responsible for errors submitted by the customer.

If you notice an error after placing an order, please contact us as soon as possible. We will make reasonable efforts to help, but we cannot guarantee changes once production has started.

6. Order Acceptance

Receiving an order confirmation does not guarantee acceptance of an order. We reserve the right to refuse, cancel, or limit any order for reasons including suspected fraud, payment issues, inappropriate content, copyright concerns, production limitations, pricing errors, website errors, unavailable products, or content that we determine is offensive, unlawful, or unsuitable for production.

If an order is canceled after payment has been collected, we will issue a refund to the original payment method unless otherwise required or agreed.

7. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, product availability, and included accessories may change at any time without prior notice. The price charged for your order will be the price shown at checkout at the time the order is placed, subject to correction for obvious errors.

Payment must be received and authorized before production begins. We may use third-party payment processors to securely process transactions. Memorial Crystals™ does not store full credit card numbers on its website.

8. Taxes

Applicable sales tax may be calculated and collected at checkout based on the shipping address, product type, local tax requirements, and other relevant factors. Tax rates and obligations may vary by jurisdiction.

9. Production Time

Production times shown on the website are estimates and may vary based on order volume, image quality, artist review requirements, product availability, supplier schedules, holidays, shipping conditions, and other factors outside our direct control. Custom crystal products require preparation, review, production, quality checks, and packaging before shipment.

We make reasonable efforts to fulfill orders within the timeframe stated at checkout or on the applicable product page. If no specific shipping timeframe is provided, online sellers are generally expected under FTC guidance to ship within 30 days or notify the customer of a delay and provide appropriate options.

10. Shipping and Delivery

Shipping times are estimates and begin after production is completed, not necessarily on the date the order is placed. Delivery dates are not guaranteed unless expressly stated in writing. Memorial Crystals™ is not responsible for delays caused by carriers, weather, holidays, incorrect addresses, customs processing, supply chain disruptions, or events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. If an order is delayed, returned, lost, or delivered incorrectly due to an address error provided by the customer, additional shipping or replacement costs may apply.

Once an order is transferred to the shipping carrier, risk of delay or loss may depend on the carrier’s tracking, insurance, and claims process. We will make reasonable efforts to assist with shipping issues, but we cannot guarantee carrier performance.

11. Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, or materially different from what you ordered, please contact us within 7 days of delivery. Please include your order number, a description of the issue, photos of the product, photos of the packaging, and any visible shipping damage.

After review, we may offer a replacement, repair, remake, store credit, refund, or another appropriate resolution at our discretion. We may require that damaged items and packaging be retained for carrier claims or returned before a replacement or refund is issued.

Minor variations in crystal appearance, engraving visibility, depth, refraction, image interpretation, light reflection, or product photography are not considered defects.

12. Returns, Refunds, and Cancellations

Because Memorial Crystals™ products are custom-made and personalized, all personalized crystal orders are generally final sale once production has started. We do not accept returns or issue refunds for buyer’s remorse, incorrect customer-submitted information, poor-quality uploaded images, customer-selected product choices, or changes of mind after production has begun.

Cancellation requests must be submitted as soon as possible after the order is placed. If production has not yet started, we may be able to cancel the order and issue a refund. If design work, 3D conversion, engraving preparation, production, or fulfillment has already begun, cancellation may not be available or may be subject to partial charges for work already performed.

Nothing in this policy limits any rights you may have under applicable consumer protection laws. Some states may require specific disclosures regarding return and refund policies, so clear website posting is important.

13. Light Bases and Accessories

Some crystal products may include a compatible light base or accessory as part of the listed product package. Included accessories, base styles, lighting effects, materials, dimensions, colors, and availability may vary by product and supplier. Product photos are intended to represent the general style and presentation of the item, but small differences may occur.

Light bases and accessories should be used only as intended. Memorial Crystals™ is not responsible for damage caused by misuse, improper power sources, drops, exposure to water, overheating, unauthorized modifications, or failure to follow any provided instructions.

14. Product Variations

Each crystal is individually produced and may have natural or manufacturing-related variations. Slight differences in dimensions, bevels, clarity, refraction, engraving visibility, brightness, internal appearance, and how the crystal looks under different lighting conditions are normal. Product images on the website may be digitally staged, photographed with lighting, or shown with sample engravings to demonstrate possible presentation.

Actual results may vary depending on the selected crystal, uploaded image, engraving style, lighting environment, and display base.

15. Intellectual Property

All website content, including text, product names, branding, logos, images, graphics, layouts, product descriptions, designs, and other materials, is owned by Memorial Crystals™ or used with permission. You may not copy, reproduce, distribute, modify, sell, or use our website content, branding, or product images without written permission.

Customer-provided photos remain the property of their respective owners. By uploading content, you grant us the limited rights necessary to fulfill and support your order as described in these Terms.

16. Prohibited Content

You may not upload or submit content that is unlawful, abusive, hateful, threatening, defamatory, sexually explicit, exploitative, invasive of privacy, infringing, or otherwise inappropriate. You may not submit images or materials that violate another person’s copyright, trademark, publicity rights, privacy rights, or other legal rights.

We reserve the right to refuse or cancel any order involving content we determine, in our sole discretion, to be inappropriate, unlawful, infringing, or unsuitable for production.

17. Website Use

You agree to use our website only for lawful purposes. You may not interfere with the operation of the website, attempt unauthorized access, use automated scraping tools, upload malicious code, misuse checkout systems, exploit pricing errors, or engage in activity that could harm Memorial Crystals™, our customers, our service providers, or our website.

We may suspend or restrict access to the website at any time if we believe these Terms have been violated.

18. Third-Party Services and Production Partners

Memorial Crystals™ may use trusted third-party service providers, payment processors, shipping carriers, software tools, design partners, and production partners to operate the website, process payments, prepare artwork, manufacture products, and fulfill orders.

We are not responsible for third-party websites, services, delays, outages, carrier failures, payment processor issues, or external platforms outside our reasonable control. Your use of third-party services may also be subject to their own terms and policies.

Your use of our website and services is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, protect, and delete certain information, including uploaded photos and order-related data.

20. Disclaimer of Warranties

Our website, products, and services are provided on an “as available” basis. To the fullest extent permitted by law, Memorial Crystals™ disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are restricted by applicable law.

We do not guarantee that the website will always be available, error-free, secure, or uninterrupted.

21. Limitation of Liability

To the fullest extent permitted by law, Memorial Crystals™ shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of data, emotional distress, delay damages, or other losses arising from your use of the website, products, or services.

Our total liability for any claim related to an order shall not exceed the amount paid for the product or service giving rise to the claim, unless otherwise required by applicable law.
